1. Purpose
These Terms and Conditions of Sale (“TCS”) set forth the terms and conditions governing the use and sale of services and subscriptions offered within the Ograal Application (“the Application”), published by Ingrid GALLERINI, Sport Dietitian, as well as the rights and obligations of the parties in this context.
Any subscription or use of the Application implies full and unconditional acceptance of these TCS.
2. Description of Services
The Ograal Application provides digital tools related to sports nutrition, including automated nutritional recommendations, meal plans, intake calculations, and other digital content.
The recommendations generated rely solely on the information provided by the User. They do not constitute medical advice, a diagnosis, or healthcare as defined by public health regulations.
3. Account Creation and Strictly Personal Use
3.1 – Account creation requires providing accurate, complete, and up-to-date information.
3.2 – The use of the account and subscription is strictly personal.
It is prohibited to:
- use one subscription for multiple individuals;
- modify gender, identity, or personal data to generate recommendations for another person;
- share access or results for professional or commercial purposes.
3.3 – Any breach may result in immediate suspension or termination of the account without refund.
This rule exists to prevent the delivery of inappropriate nutritional recommendations that may pose a health risk to any user.
4. Subscriptions
4.1 – Free
The Application Ograal is free
5. Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to digital content supplied immediately or services whose execution begins before the end of the legal withdrawal period with the User’s express consent.
6. Personal Data
The data provided by the User is necessary for the provision of services.
Under the GDPR, the User has the right to:
- access,
- correct,
- oppose,
- delete their data.
These rights may be exercised by contacting: contact@ograal.com.
Any request for deletion of data results in the permanent deletion of the User’s account.
A detailed Privacy Policy is available within the Application and on the website.
7. User Obligations
The User agrees to:
- provide accurate and truthful information;
- refrain from using the Application for fraudulent, inappropriate, or diverted purposes;
- avoid using recommendations intended for someone else.
8. Liability
8.1 – No Medical Responsibility
The recommendations generated by the Application result from algorithms based on the information entered by the User.
They are provided for informational purposes only.
The Publisher does not guarantee that the recommendations are appropriate for a person with a medical condition of any kind.
8.2 – Full Disclaimer of Liability
The User acknowledges that the Application does not take into account:
- known or unknown medical conditions (including, but not limited to: diabetes, kidney insufficiency, cardiovascular diseases, metabolic disorders, autoimmune diseases, digestive disorders, etc.);
- food allergies or intolerances;
- prescription or non-prescription medications;
- specific physiological states (pregnancy, growth-specific parameters, injuries, etc.).
Consequently, the User assumes full responsibility for the use of the recommendations provided.
The Publisher shall not be held liable for any direct or indirect damages, including but not limited to:
- allergic reactions;
- medical complications;
- hypoglycemia, digestive issues, dehydration;
- aggravation or onset of a pathology;
- errors resulting from incorrect or incomplete information entered by the User;
- any impact on the User’s performance or health.
This disclaimer applies without exception.
9. Suspension or Termination by the Publisher
The Publisher may suspend or terminate any account in the event of:
- breach of these TCS;
- fraudulent use;
- health risk resulting from improper use of the Application;
- non-payment.
No refund will be issued.
10. Intellectual Property
All elements of the Application (content, texts, images, algorithms, structure, brand, etc.) are protected by intellectual property laws.
Any reproduction or distribution, in whole or in part, is strictly prohibited without written authorization.
11. Force Majeure
The Publisher shall not be held liable in cases of force majeure as defined by French case law.
12. Governing Law – Jurisdiction
These TCS are governed by French law.
Any dispute relating to their interpretation or execution that cannot be resolved amicably shall fall under the exclusive jurisdiction of competent French courts.
